At Cybernut Inc. ('the company', 'we', or 'us'), we respect your privacy and are committed to protecting it through as described in this privacy policy ('Policy' or the 'Privacy Policy'). This policy describes the types of information we may collect from you or that you may provide when you use our product, Cybernut ('the product', 'the service', 'the website', 'the app', or 'product'), and our practices for collecting, using, maintaining, protecting, and disclosing that information. Your use of the Product and Services and any information you provide on the Services are subject to the terms of this Privacy Policy, which is incorporated into and subject to our Terms of Service.

DATA COLLECTION

We collect Personal Information you provide to us, as well as Personal Information collected automatically and from third-party sources such as the schools. If you are an end user of a school that uses our Product, your institution may have provided us with data to deliver the services. For the purpose of this policy, Personal Information is defined as information that identifies, relates to or could reasonably be linked with or describes an individual or household, either directly or indirectly.

Personal information of users is not collected by a third party. Aggregated or combined information, representing a collective summary of data, is treated with the same level of confidentiality and protection as personally identifiable information (PII) on our platform.

Users cannot create or upload content. User information does not have to be shared or revealed in order to participate in social interactions. Social interactions of users are logged.

HOW WE USE YOUR PERSONAL INFORMATION

The service is designed to be used in schools by educators and students. We use personal information only to support the purposes outlined in this agreement, and we rely on the schools that use Cybernut to obtain any necessary consent for users of the product that are ages 13 and under. The Collection or use of data by the product is limited to the product requirements. This includes:

Service delivery (such as provide, operate and improve the Service and our business, review, screen and monitor user created content.), Research, Marketing and advertising, Compliance, and Retention.

This includes the context or purpose for which data is collected is indicated below. Data is not collected by the product or service for the purpose of tracking. Partners and third-parties may not create data profiles for personalised advertisements. User-created content is reviewed, screened, or monitored by the company.

We maintain a formal Data Processing Agreement to establish clear guidelines on the lifecycle management of our data, ensure compliance with legal and regulatory requirements, bolster data security, and demonstrate a commitment to responsible and transparent data management practices within our organization. Personal Data that we collect will be deleted when it is no longer necessary to provide you with our services. We delete Personal Data upon account cancellation or termination.

In some cases, we may retain Personal Data beyond the length of time that you have an account with us in order to resolve disputes, comply with legal and compliance obligations, or otherwise. Anonymized data, which is no longer attached to you personally, may be retained for longer periods of time.

HOW WE SHARE YOUR PERSONAL INFORMATION

Collected information is not shared with third parties. Data is not shared for analytics. Data is not shared for research and/or product improvement. Personal information is not shared for third-party marketing. Personal information is not sold or rented to third parties. Third-party services are not used to support the product. Contractual limits are placed on third-party data use. In the event of a merger, acquisition, or bankruptcy user information may be transferred to a acquiring third party. Third-parties with access to information are required to provide the same security protections as the company. Personal information can be displayed publicly. Data is not collected by third-parties for the purpose of tracking.

YOUR CHOICES

We provide authorized employees a method to access or review a user's personal information in accordance with our security and access policies. We do not display any contextual, personalized, or targeted advertising in the product. Users can opt out of some types of marketing. Choices for marketing opt-out are listed below.

Users have the option to opt-out or unsubscribe from both the company's first-party marketing communications and third-party marketing. Users can control the use of their information through privacy settings.

To use our Products and Services, you can be required to create an account. During the account creation process, we will collect certain information to establish and manage your account effectively. This information may include, but is not limited to, your name, email address, and a password of your choice.

The Service may contain links to websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or other online services that are not associated with us. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions.

Third-party login is supported for authentication into our Product or Services. When you choose to log in to our services using third-party authentication, such as through email accounts or other external identity providers, we collect certain information from your chosen third-party platform. This may include basic profile details, such as your name and email address. By opting for third-party login, you grant us permission to access and use this information to create and manage your account. We may also request additional permissions during the authentication process, depending on the requirements of the third-party provider.

COOKIES

A cookie is a text file that is placed on your hard disk by a web page server. Our Product does not use cookies to customize your experience.

SWEEPSTAKES, CONTESTS AND OTHER PROMOTIONS

We do not ask users to participate in any third-party sweepstakes, contests, or other similar promotions.

SECURITY

Reasonable security practices are used to protect data. Employee and physical access to user information is limited. All data in transit is encrypted. All data is stored in an encrypted format. Users are provided notice in the event of a data breach. Multi-factor account protection is available.

CHANGES TO THIS PRIVACY POLICY

Notice is provided if the context in which data is collected changes. We will obtain consent from users if the practices in which data is collected change.

YOUR PRIVACY RIGHTS

Except as otherwise provided, this section applies to residents and data subjects of states and jurisdictions where there are privacy laws applicable to us that grant their residents the rights described below.

For purposes of this section, “personal information” has the meaning given to “personal data”, “personal information” or similar terms under the applicable privacy laws of the state in which you reside. Authorized Agents: Your authorized agent may be able to make a request on your behalf. However, we may need to verify your authorized agent’s identity and authority to act on your behalf. We may require a copy of a valid power of attorney given to your authorized agent pursuant to applicable law. If you have not provided your agent with such a power of attorney, we may ask you to take additional steps permitted by law to verify that your request is authorized, such as by providing your agent with written and signed permission to exercise your rights on your behalf, the information we request to verify your identity, and confirmation that you have given the authorized agent permission to submit the request.

Access: You can request a copy of the personal information that we have collected about you. Deletion: You can request that we delete your personal information. Please note that once we process a deletion request, we may be unable to provide access or support to any past products or services.

CHILDREN’S PRIVACY NOTICE

Our service is designed to be used in schools by educators and students. This may include children 13 and under as well as teens. We rely on the schools that use Cybernut to obtain any necessary consent for users of the product ages 13 and under. However, parents have the right to withdraw consent for the collection of their child's information at any time. There are no social features in the product so there are no user interactions with untrusted individuals, including strangers and adults.
